- General/validity
- These general trading conditions are the basis for all deliveries and achievements of personal-websites.eu.
- Deviating and/or supplementing agreements require the expressive written agreement of personal-websites.eu. An agreement by e-mail is sufficient.
- Offer
- All offers of personal-websites.eu on the Internet site of www.personal-websites.eu are noncommittal and not-binding. Small deviations and technical changes to our illustrations or descriptions are possible.
- The contract is achieved by the conclusion of the order procedure on the Internet site of personal-websites.eu and confirmation of the order by personal-websites.eu by E-Mail or execution of the order by personal-websites.eu.
- Prices and terms of payment
- The prices represented on the Internet sites of personal-websites.eu apply at the time of the order. All prices mentioned are end user prices in british Pounds (£) or Euro (€) and do not contain any value added tax.
- Packaging and forwarding expenses do not apply. Obvious price mistakes are reserved.
- In case of a price adjustment during time of delivery e.g. due to material raising the price, changes of wages and of the scales of salaries, the parties commit themselves to footstep to negotiate immediately about one of these changes corresponding price adjustment. The computation takes place at the prices valid at the day of delivery. With actualisation of the offer, the price list, or the web page all previous prices lose their validity.
- personal-websites.eu accepts all payment means offered on the Internet site of personal-websites.eu within the order procedure. The customer selects the preferential payment means. By payment means (possible) additionally arising costs (e.g. collection fee) are likewise additionally computed.
- An accounting of mutual requirements is possible only with expressive written agreement of personal-websites.eu.
- Supply, delivery times and forwarding expenses
- Delivery times are indicated according to best knowledge and certain and possibly kept, if during placing of order all technical and/or organizational details of order contents and - extent are obligatorily fixed.
- Based on not timely receipt of all documents which may be provided by the customer, declarations which may be made and during disregard of any other obligations of the customer the time for delivery extends appropriately.
- Delivery of the supplies to the customers takes place via the third party (delivery services), indicated within the order procedure. Forwarding expenses will be given the customer before releasing the order procedure within the shopping list.
- Supplies readily available will be delivered within three to four working-days after payment receipt. For supplies not readily available delivery time amount up to four to six weeks after order placement.
- For the possibility of delivery personal-websites.eu depends on the timely supply themselves. If the delivery fails for reasons, which are not to be blamed on personal-websites.eu, then personal-websites.eu may withdraw from the contract. personal-websites.eu commits itself to inform the customer in a timely manner about it. Any performed payments are returned immediately. In this case a right to payment of damages is not entitled to the customer.
- Partial deliveries are permissible, as far as the customer does not have recognizably disinterest in them or these are not recognizably reasonable. The costs of transport and packaging are computed only once in this case.
- Instruction about the conversion and return right
- All articles acquired from personal-websites.eu may be returned within two weeks after receipt of the supplies, without indication of any reasons. The period starts at the earliest with receipt of the supplies and this instruction. Timely mailing of the commodity meets the period. The return right does not exist for those supplies according to § 312d IV BGB with unsealed audio, video or software data media, or goods produced according to customer specifications (e.g. special orders, which must be particularly ordered).
- Payments performed by the contracting party are made within 5 working-days after receipt of the returned supplies by transfer to an account in the UK or Germany, which may be designated by the customer.
- Up to a commodity value of 60 british Pounds the return has to take place at expense and danger of the customer. The return transportation costs within Germany starting from a purchase order value of 60 british Pounds will be accepted by personal-websites.eu. The return must be sufficiently franked. The postage costs of the return (on basis of the most favourable possible mode of shipment) are refunded within 5 working-days after receipt of supplies to an account in the United Kingdom or Germany, which may be designated by the customer.
- If personal-websites.eu has to bear additional costs resulting from an insufficient franking of the return, then these costs with any performed payments of the customer are charged. The return of the commodity has to take place in the original packaging. If this should not be possible, then the customer must provide for a packaging, which excludes a damage of the commodity.
- For damage to the supplies, which is due to an insufficient packaging, the customer is responsible. personal-websites.eu expressly reserves the right to claim for damaged commodity. If the customer has to accept a degradation or ruin or any other impossibility then he has to replace the depreciation; §§ 351 and 353 BGB are not to be used.
- Obvious lack (in particular damages, wrong deliveries or quantity discrepancies), transport damages or other lack of quantity must be immediately reported to personal-websites.eu in writing, at the latest however within a period of 14 calendar dates from receipt of the commodity. The report by e-mail to info @ personal-websites.eu is sufficient.
- Passage of risk
- The supply of the commodity will take place on danger of the customer. The danger turns over to the customer with delivery of the commodity to the transport enterprise. This applies also, if personal-websites.eu accepted the transport costs. Because of transport damages (packaging e.g. damaged with the receipt of the commodity) the customer has to object directly in relation to the transport enterprise within the stated periods.
- Warranty
- Requirements of the customer pertaining to payment of damages, e.g. because of default, being to blamed for with contract conclusion, injury of contractual additional obligations, lack damages, damage from bad action and other arguments are impossible. Exceptionally from it personal-websites.eu is liable with the absence of an assured characteristic, with resolution or rough negligence. Requirements from the product liability law are not affected by this.
- If lack should arise, which personal-websites.eu has to accept, and in case of the conversion of the commodity the replacement is again unsatisfactory, then the right to transformation or reduction is entitled to the buyer. personal-websites.eu is not liable neither for the constant and continuous availability of www.personal-websites.eu nor for technical or electronic errors of the online offer.
- Retention of title
- All deliveries take place under retention of title. The supplied commodity remains property of personal-websites.eu up to the complete payment of the purchase price.
- Data storage/data security
- In accordance with §28 BDSG (Federal Law for Data Protection) we would like to inform you of the fact that in the context of the business transaction the necessary data are processed and stored by means of an EDP equipment in accordance with § 33 BDSG. All personal data raised from the customer are confidentially treated. Exclusively in the context of the order handling (payment, dispatch) the necessary data are also being used with third party.
- At any time you may receive free of charge information about your data stored. Therefore please send an e-mail to info @ personal-websites.eu. For data security reasons the answer of the Mail may only be made to the e-mail address as listed with personal-websites.eu.
- Area of jurisdiction
- Area of jurisdiction for all disputes in connection with the delivery services is as far as compatible, the area of jurisdiction of personal-websites.eu.
- The location of personal-websites.eu is agreed upon as area of jurisdiction if the contracting party has no general area of jurisdiction in Germany or the contracting party changes domicile after contract conclusion or the domicile of the contracting party is not known at the time of the complaint.
- The contracting parties agree upon the application of the right of the United Kingdom under exclusion of the UN Sales law regarding all legal relations from this contractual relation.
- Additional clause
- The nullity or inefficiency of individual regulations of these General Trading conditions does not affect the validity of the remaining regulations. Futile or ineffective conditions are replaced by the legal regulations.
